FyScope Terms of Service

Effective date: June 1, 2026

These Terms of Service (“Terms”) are a binding agreement between you and FyScope (“FyScope,” “we,” “us,” “our”) and govern your use of FyScope’s lead-brokering service (the “Service”).

By accessing or using the Service you agree to these Terms. If you do not agree, do not use the Service.

1. What the Service is

FyScope is a lead broker. We accept loan-application information from you, share it with consumer-lending companies in our network (“Lenders”) so they can evaluate you for prequalification or origination, and present back to you any offers the Lenders make.

FyScope is not a lender. FyScope does not extend credit, set rates or terms, decide approvals, or service loans. All credit decisions are made by the Lender, on the Lender’s own underwriting, under a separate agreement between you and the Lender.

FyScope does not obtain consumer credit reports about you. Any consumer-report inquiry is initiated by a Lender, after the Lender obtains its own separate authorization from you, under the Lender’s own Fair Credit Reporting Act compliance program.

The Service is free for you to use. Lenders pay FyScope when applications we submit to them are accepted or funded. This compensation does not change the offers Lenders present to you and is described more fully in our Privacy Notice and in the consent form you must agree to before we share any of your information.

2. Eligibility

You may use the Service only if you:

• are at least 18 years of age;
• reside in a US state or territory where we operate;
• are a US person for tax and lending-law purposes;
• are not a person or entity barred under US law from receiving loans (including OFAC sanctions lists);
• provide accurate and truthful information; and
• have the legal capacity to enter into and be bound by these Terms.

If you do not meet these requirements, you may not use the Service.

3. Your account and information

You do not need to create a standing account to use the Service. Each application is a single session.

You agree to provide accurate, current, and complete information. Submitting false, misleading, or fraudulent information is a breach of these Terms and may violate federal and state law. We may refuse, suspend, or revoke service to anyone we believe has provided false information.

You are responsible for the security of the device, network, and browser you use to access the Service. Do not enter your information on a device or network you do not trust.

4. Authorization to share your information

Before we share your information with any Lender or verification provider, you must read and agree to our Authorization to Share Information with Lenders for Prequalification (the “Consent”). The Consent describes:

• the categories of information we share;
• the categories of recipients;
• how we are paid;
• the third-party verification and fraud-prevention providers we use;
• your rights under federal and state law; and
• how to withdraw the authorization.

If you do not agree to the Consent, you cannot complete an application through the Service. The Consent in effect at the time you click “I Agree and Continue” is the operative document; you can request a copy of the exact text at any time.

5. No guarantee of approval or particular terms

FyScope makes no representation or warranty that:

• any Lender will offer you a loan;
• any offered loan will be on terms you find acceptable;
• the rates, fees, term, or amount of any offer will match any indicative figures shown on the Service; or
• any specific Lender will be available to you.

All offers are subject to the Lender’s underwriting, identity verification, and compliance with applicable law. Lenders may decline to offer you a loan for any reason permitted by law.

6. Acceptable use

When using the Service you agree not to:

• submit information that does not belong to you, or impersonate another person;
• use the Service to commit fraud, money laundering, identity theft, or any other unlawful purpose;
• interfere with, disrupt, or attempt to gain unauthorized access to the Service or any underlying systems;
• attempt to reverse-engineer, scrape, or otherwise extract bulk data from the Service;
• use any automated means (bots, scripts, scrapers, browser-automation tools) to interact with the Service other than as expressly permitted by these Terms; or
• submit content that is unlawful, harmful, harassing, defamatory, or that infringes any third-party right.

We may suspend or terminate access to the Service for any user we believe has violated these Terms, with or without notice.

7. Intellectual property

The Service, including its software, design, content (excluding your personal application information), trademarks, and logos, is owned by FyScope or its licensors and is protected by US and international intellectual-property laws. You may not copy, modify, distribute, sell, or lease any part of the Service except as expressly permitted by these Terms.

8. Third-party links and Lender sites

The Service may present links to Lender websites or applications so you can complete an offer. Those websites are operated by third parties under their own terms of service and privacy policies. FyScope is not responsible for the content, products, or practices of any third-party site.

9. Disclaimers

The Service is provided “as is” and “as available.” To the maximum extent permitted by law, FyScope disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

FyScope does not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components. FyScope does not warrant the accuracy, completeness, or reliability of any information you receive through the Service, including any offer presented by a Lender.

10. Limitation of liability

To the maximum extent permitted by law, FyScope and its officers, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, revenue, goodwill, or data, arising out of or relating to these Terms or your use of the Service.

Our total aggregate liability to you for any claim arising out of or relating to these Terms or the Service will not exceed the greater of (a) one hundred US dollars (US $100) or (b) the amount we received from Lenders attributable to your application.

Some jurisdictions do not allow the exclusion or limitation of certain damages. In those jurisdictions, the above limitations apply to the maximum extent permitted by law.

11. Indemnification

You agree to indemnify, defend, and hold harmless FyScope and its officers, directors, employees, and agents from any claim, demand, loss, liability, damage, or expense (including reasonable attorneys’ fees) arising out of or relating to (a) your breach of these Terms, (b) your violation of any applicable law or third-party right, or (c) information you submitted that is false, misleading, or fraudulent.

12. Governing law and disputes

These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws principles.

Any dispute arising out of or relating to these Terms or the Service that is not subject to binding arbitration under Section 13 will be litigated exclusively in the state or federal courts located in New Castle County, Delaware, and you and FyScope consent to the personal jurisdiction of those courts.

13. Arbitration and class-action waiver

Please read this section carefully. It affects your legal rights.

You and FyScope agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Service (“Disputes”) will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, with the arbitration to take place in the county of your residence or, at your option, by telephone or video.

You and FyScope each waive the right to a trial by jury or to participate in a class action, class arbitration, or representative action. The arbitrator may not consolidate the claims of multiple persons.

You may opt out of this arbitration agreement by writing to Contact via Email within 30 days after first agreeing to these Terms, with the subject “Arbitration Opt-Out” and your full name and the email address you used. Opting out has no effect on the rest of the Terms.

Nothing in this section bars you from bringing a claim in small-claims court for any matter within that court’s jurisdiction.

14. Termination

You may stop using the Service at any time. We may suspend or terminate the Service or your access to it at any time for any reason, including violation of these Terms, suspected fraud, or as required by law.

Sections that by their nature should survive termination (including Sections 7, 9, 10, 11, 12, 13, and 16) will survive.

15. Changes to these Terms

We may update these Terms from time to time. When we make material changes we will post the updated Terms with a new “Effective date” and, where required by law, provide additional notice. Continued use of the Service after a change indicates acceptance of the updated Terms.

16. Miscellaneous

• Entire agreement. These Terms, together with the Consent and the Privacy Notice, are the entire agreement between you and FyScope regarding the Service.
• Severability. If any provision is found unenforceable, the remaining provisions remain in effect.
• No waiver. Our failure to enforce any provision is not a waiver of our right to do so later.
• Assignment. You may not assign these Terms. We may assign these Terms in connection with a merger, acquisition, financing, reorganization, or sale of assets.
• Notices. We may provide notices to you by email or by posting on the Service.
